These terms are between you and Virgin Activities LLC, United States ("Nerve", "we"). They cover the Nerve iOS app ("Nerve Manifest"), thenerveapp.com and our support channels. By using them you agree to these terms and to the Privacy Policy.
1. Who can use Nerve
You must be at least 18 years old, or the age of majority where you live if that is higher, and able to enter a binding contract. The app's content is written for adults.
2. What Nerve is — and is not
Nerve writes short first-person stories, affirmation cards and a daily read from the answers you give and, for the read, from the positions of the planets on your birth date. It is a tool for visualisation, reflection and motivation.
- Not advice. Nothing in Nerve is financial, investment, legal, medical, psychological or relationship advice, and nothing is a prediction. Astrology content is offered for reflection and entertainment. Decisions about money, relationships and health are yours; speak to a qualified professional for advice.
- No guarantee of outcomes. Stories describe a future you asked for. We do not promise that any result — wealth, a relationship, a purchase, anything — will happen.
- Generated content. Stories and reads are assembled by software from your answers and our writing, and narration is synthesised speech, not a recording of a person. Content may be imperfect; tell us through the feedback sheet.
- People you name. Stories can include names you give us (a partner, a friend). You are responsible for what you enter about other people; keep it respectful and do not enter information about anyone under 18.
- Crisis. If you need urgent help or feel unsafe, contact emergency services or a qualified professional. Nerve is not a crisis service.
3. Your licence
We grant you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, under the App Store rules. You may not copy, modify, sell, rent, reverse engineer or extract the app or its content, or use it to build a competing product. The stories written for you are yours to keep and share for personal use; our writing, design, photographs (licensed from Pexels), the mascot and the name Nerve remain ours or our licensors'.
4. Subscriptions, trials and cancellation
- Plans. Access to stories, reads, steps, the affirmation deck and the sleep and meditation library requires a subscription. Prices and periods (weekly, monthly, yearly) are shown before you buy and in your Apple or Stripe receipt.
- Free trial. Where a trial is offered, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends.
- Auto-renewal. Subscriptions renew automatically at the same price and period until you cancel. Your account is charged within 24 hours before the end of the current period.
- Cancelling. iOS: Settings ▸ [your name] ▸ Subscriptions (or You ▸ Manage subscription in the app). Web: the billing portal from your profile page. Cancelling stops the next renewal; you keep access until the end of the period you paid for. Deleting the app or your account does not cancel a subscription.
- Refunds. Purchases through Apple are refunded by Apple under its policies (reportaproblem.apple.com). Web purchases: email us within 14 days of a charge you did not intend and we will review it. Nothing here limits statutory rights where you live.
- Promotional codes. Creator codes may grant access or credit; they are not cash, cannot be sold, and we may withdraw a code that is misused.
- Price changes. We will tell you before a price change takes effect; Apple or Stripe will ask for your consent where the law requires it.
5. Accounts
An account is optional. You are responsible for keeping your login safe and for what happens under it. You may delete your account at any time from You ▸ Delete account; see the Privacy Policy for what that removes.
6. Acceptable use
Do not misuse the app: no scraping, automated access, reverse engineering, interfering with the service, uploading unlawful or abusive content, or using the app to harass or defame anyone. We may suspend or end access for breaches.
7. Feedback
When you rate a story or send us comments you give us a free licence to use them to improve Nerve. We read feedback ourselves; it never changes the app automatically.
8. Apple
If you got the app from the App Store: these terms are between you and Nerve, not Apple. Nerve is responsible for the app and its support; Apple has no obligation to provide maintenance or support. If the app fails to conform to a warranty, you may notify Apple and Apple may refund the price you paid; Apple has no other warranty obligation. Apple is not responsible for claims relating to the app (product liability, legal compliance, consumer protection, IP). You represent you are not in a US-embargoed country or on a US restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of this section.
9. Disclaimers and liability
The app is provided "as is". To the fullest extent the law allows we disclaim implied warranties, and we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits. Our total liability for any claim is limited to the greater of US $100 or what you paid us in the twelve months before the claim. Some places do not allow these limits; where they do not, they apply as far as permitted.
10. Governing law and disputes
These terms are governed by the laws of the State of California and the United States. Disputes will be handled in the state or federal courts of California, unless the law where you live gives you the right to bring them locally. Try us first — most problems are solved by email within a few days.
11. Changes
We may update these terms; the effective date at the top changes and material changes will be shown in the app. Continued use after a change is acceptance.
